These Terms of Service (“Terms”) govern your use of the Arkhipelag website (arkhipelag.shop) and any tour bookings made through our marketplace. By using our site or booking a tour, you agree to these Terms.

1. Our role as a marketplace

Arkhipelag is an online marketplace that connects travelers with independent tour operators in Thailand. We do not operate tours, provide guides, or own any boats, vehicles, or equipment used during tours.

Our responsibility is limited to:

  • Providing a platform where you can discover and compare tours
  • Processing your payment safely
  • Forwarding your booking to the selected tour operator

The tour operator alone is responsible for delivering the tour as described, ensuring safety, providing equipment, and complying with all applicable laws.

2. Booking and payment

When you book a tour through Arkhipelag:

  • You must provide accurate information (name, contact details, hotel location)
  • You must be at least 18 years old to make a booking
  • Full payment is required at the time of booking unless otherwise stated
  • A booking confirmation will be sent to your email address

We reserve the right to cancel any booking if payment is not received or if we suspect fraud.

3. Changes and cancellations

All cancellations and refunds are governed by our separate Refund Policy, which is available on our website.

In summary:

  • Most tours offer free cancellation up to 24 hours before the start time
  • Cancellations within 24 hours of the tour are generally non-refundable
  • If a tour operator cancels for any reason, you receive a full refund

Please review the Refund Policy before booking, as specific tours may have different terms.

4. Tour operator responsibility

The tour operator is solely responsible for:

  • Providing the tour as described on the listing (including safety, equipment, guide services, and food)
  • Complying with all local laws, permits, and safety regulations
  • Handling any accidents, injuries, or losses during the tour
  • Communicating with you about pickup times, weather changes, or schedule adjustments

Arkhipelag is not liable for any injury, damage, loss, or delay arising from the acts or omissions of any tour operator.

5. Your responsibilities as a customer

By booking a tour, you confirm that:

  • You understand the physical demands of the tour (e.g., swimming, walking on uneven terrain, boat motion)
  • You do not have any medical conditions that would make participation unsafe (e.g., pregnancy, back problems, heart conditions — see individual tour warnings)
  • You will arrive at the pickup point on time
  • You will follow all safety instructions given by the tour guide or boat captain

Failure to meet these responsibilities (e.g., late arrival, ignoring safety rules) may result in the tour being canceled without refund.

6. Weather and natural conditions

Some tours (especially island and snorkeling trips) depend on good weather. The decision to operate or cancel a tour is made by the tour operator based on official marine authority guidelines.

  • If the operator cancels due to unsafe weather, you receive a full refund or reschedule option
  • If the tour operates as scheduled, no refund is given for less-than-perfect conditions (light rain, clouds, moderate waves)

7. Liability limits

To the maximum extent permitted by law:

  • Arkhipelag’s total liability to you for any claim arising from these Terms or your use of our platform is limited to the amount you paid for the tour in question.
  • Arkhipelag is not liable for any indirect, incidental, or consequential damages (e.g., lost vacation time, missed flights, accommodation costs) arising from a canceled or delayed tour.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence (where applicable by law).

8. Your account

If you create an account on Arkhipelag:

  • You are responsible for keeping your login credentials secure
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Prohibited conduct

You agree not to:

  • Use our site for any unlawful purpose
  • Attempt to book a tour using false information
  • Harass, threaten, or abuse our staff or tour operators
  • Post false reviews or manipulate tour ratings
  • Copy, scrape, or redistribute our content without permission

Violation of these rules may result in a permanent ban from Arkhipelag.

10. Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated date. If we make significant changes, we may notify you by email or a notice on our website.

Your continued use of Arkhipelag after changes take effect constitutes your acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Thailand. Any disputes arising from your use of Arkhipelag or your tour bookings shall be resolved in the courts of Phuket, Thailand.
